Workshop on Procedural Safeguards
in Competition Enforcement

This one-day workshop, open only to representatives of competition authorities, focused on how agencies can best exercise their evidence gathering, decision-making and assessment powers in the respect of the procedural safeguards of the parties. It explored how investigation, competition assessment and judicial review interact with due process requirements, such as the presumption of innocence, proportionality, the right to be heard, the protection of the legitimate expectations of the parties and the exercise of judicial review. Workshop on Competition in Digital Markets: Recent Enforcement and New Regulations
24 February 2023
This workshop focused on recent regulatory initiatives enacted or proposed across OECD jurisdictions for competitive digital markets. In particular, it explored data-related and self-preferencing issues as well as the solutions envisaged by the new regulations (e.g., interoperability, data portability, restrictions on the cross-use of personal data). In addition, representatives of competition authorities presented recent competition enforcement cases that shed some light on the main theories of harm and remedies developed under traditional competition law provisions in order to address similar concerns.
